Litigation and Administrative Law

Curtis Thaxter’s Litigation and Administrative Law Practice Group represents clients in different forums on a variety of issues.  Our attorneys appear regularly before state and federal courts and agencies, municipal boards, and various arbitration panels.  Attorneys in this practice area have developed an in-depth knowledge of our client’s business, profession or industry, and provide timely advice and responsive service to resolve disputes in a cost-effective manner.
 
Our attorneys have expertise resolving disputes in a number of business areas through general civil litigation, including:  telecommunications, construction, commercial contracts, healthcare, insurance, creditor’s rights, land use and property rights.  In addition, Curtis Thaxter handles litigation in employment and discrimination disputes, intellectual property, personal injury and product liability.
 
In the Administrative law area, the firm’s practice is concentrated in advising clients before various agencies in the State of Maine including:  the Public Utilities Commission, the Bureau of Insurance, the Department of Health and Human Services, the Department of Revenue Services, the Department of Environmental Protection, and various professional and business licensing boards.  The firm, through its Energy, Utilities and Telecommunications practice has gained expertise in matters before the Federal Energy Regulatory Commission, and has served as outside general counsel overseeing firms in other states handling litigation and regulatory matters for clients.
 
The firm has pursued cost-effective, negotiated resolution of client disputes if possible and in keeping with the business objectives of the client.  When a negotiated resolution has not been possible, the firm has had favorable experience in administrative hearings and appeals.  For example, the firm served as lead counsel for the Associated Contractors of Maine in establishing the prevailing wage for all public works projects in the State for a leading managed care company in securing the $100 million per year contract for the State of Maine Employees’ Health Insurance program, and for the company that ultimately won the ten-year contract to operate the Maine State Lottery.
 
The firm's attorneys have significant expertise in land use and environmental law.  They appear before local planning and zoning boards of appeals, and take appeals of such decisions to the Superior Court.  They handle property tax abatement cases.  In environmental law, our attorneys work with clients to obtain permits and resolve compliance disputes.
 
The firm has substantial experience in handling appeals of decisions of state agencies and local boards to the courts.
